I. The controller of the processing 

The legal entity controlling the processing of your personal data is JK INVEST NV (hereafter ‘JKI’). JKI is a Belgian company whose registered office is located at Emmanuel Mounierlaan 2, 1200 Sint-Lambrechts-Woluwe.  JKI is registered with the Register for Legal Entities in Belgium under number 0838.758.406.

II. Purposes and legal basis for the processing of personal data

JKI processes personal data of applicants for potential investment projects (hereafter ‘Applicants’), suppliers, and partners, as well as of their contact persons, and of visitors to its website, for the following purposes:

1. Processing of personal data of Applicants, contact persons of Applicants and potential Applicants for the purpose of investigating investment opportunities for JKI upon the (potential) Applicant’s request.
2. Processing personal data of suppliers and partners and potential suppliers and partners, as well as their contact persons, for the purpose of the supplier or partner relationship as well as legally required purposes that are linked to that purpose.
3. Processing of personal data of visitors to our website that fill out the contact page (e.g. for submitting a pitch for a potential investment or for any other contact request), for the sole purpose of responding to the visitor’s request sent to us via the contact page.

The legal basis for these processing operations is respectively:

• For 1: - The necessity for the purpose of the legitimate interests pursued by JKI and the Applicants to organize, and interact in relation to, the investigation of a potential investment opportunity.
• For 2: - The necessity for the purpose of the legitimate interests pursued by JKI and the supplier or partner to organize, and interact in relation to, the conclusion or performance of a contract. - The necessity for the performance of our contract with our supplier or partner.
• For 3: - The necessity for the purpose of the legitimate interests pursued by JKI to treat and give follow up to a visitor’s request on the contact page of our website.

In addition, we may also process your personal data for the above purposes:

• On the basis of your consent.
• If required for legal reasons. The legal basis of our processing is then to be found in European or national law.

IV. Duration of the processing and retention of data

For Applicants:

We retain your personal data for as long as necessary for the purpose of investigating the proposed investment opportunity for JKI.

For suppliers and partners:

We process your personal data as long as necessary in the context of the contracts entered into with you. After termination of our active collaboration with you, your personal data are retained for as long as necessary for legal, compliance or tax and accounting reasons, or for future reference.

For visitors to the website that fill in the contact form:

We process your personal data as long as necessary to deal with and give follow up to your request. The data are not retained afterwards (unless the case being, in the context of processing for another purpose as detailed in this privacy policy).

Under certain circumstances, we may disclose your personal data:

• If permitted or even required by law (for example, in the context of legal proceedings).  
• When we need to share Applicants’ data with third parties in the course of investigating the proposed investment opportunity, e.g. in the context of a due diligence the data will be shared with legal advisors and technical partners.

V. Your rights in relation to the processing of your personal data

In relation to the personal data that are processed by JKI, you have a number of legal rights:

• You have a right to get access to your personal data and to have these data corrected.
• You may ask JKI to erase your personal data, or to restrict the processing thereof.
• To the extent that the processing is based on the legal basis of a legitimate interest, you have the right to oppose to that processing.
• To the extent that the processing is based on your consent, you have the right to revoke your consent at any time.

Within a duration of maximum 1 month after receipt of your request, we will act upon your request and reply. If for some reason we cannot accommodate your request, we will inform you of the reasons thereof. If we are not in a position to identify you properly, we may ask you to provide a proof of your identity as a prerequisite to accommodating your request.
